Deaccession ContracteBay Sales ContractBixby Auctioneers and Appraisers, LLC agree to accept the following items to be sold at auction on the Internet subject to the conditions and fees as explained below. Consignor agrees to advise Bixby Auctioneers and Appraisers, LLC to the best of their ability as to the history and condition of items being consigned for sale at auction. Any item which is not as described may void an auction sale and the item may or may not be offered again with revised description. Expenses incurred in such an event will be paid by the consignor. By accepting items, Bixby Auctioneers and Appraisers, LLC agrees to make a good faith effort to sell them at auction on behalf of the consignor and will list them for public auction or notify the consignor that they cannot do so within 30 days. Any item not sold will be returned to the consignor, who must pick it up from Bixby Auctioneers and Appraisers, LLC within 60 days of notification, or it becomes the property of Bixby Auctioneers and Appraisers, LLC. Return of an item fulfills all obligations on the part of Bixby Auctioneers and Appraisers, LLC as it pertains to that item. The consignor and Bixby Auctioneers and Appraisers, LLC have mutually agreed upon an estimated value of each item. This is ONLY an estimate and no guarantee is made that any item will sell at or above the estimated value. The estimated value is based on previous sales at auction and the auctioneer's personal experience. The 50% of the estimated value is used as a starting point for the auction and assures if sold, the item will not go for less than this. All items accepted will be sold at absolute auction without reserve in fixed time auction. Auction will be opened at 50% of estimated value and will sell to highest bidder. In the event that no bids are placed for an item, Bixby Auctioneers and Appraisers, LLC will offer it a second time approximately one week after the close of the first auction. Items that receive no bids after a second attempt will not be offered again and consignor will be notified to pick them up. Expenses incurred to eBay for items not selling will be paid by Bixby Auctioneers and Appraisers, LLC. Items mutually agreed by consignor and Bixby Auctioneers and Appraisers, LLC to be too large or heavy to ship economically will be offered only to bidders who agree to pick them up from the location that they reside. All other items will be offered to a national or international market, depending on item, and decisions on appropriate market size shall be at the sole discretion of Bixby Auctioneers and Appraisers, LLC. Bixby Auctioneers and Appraisers, LLC will retain 25% of closing bid for services rendered. The balance, (75% of closing bid less eBay/PayPal expenses for items selling for less than $300.00, full 75% for items selling at $300.00 and above) will be paid to the consignor within 45 days of receipt of payment for the item by check barring any disputes by winning bidder through eBay / PayPal, and such payment will complete the obligation to the consignor for that item. Payment for disputed items will be paid by check when dispute has been resolved by eBay/PayPal. Consignor will be compensated for any item lost, damaged or stolen while in the physical possession of Bixby Auctioneers and Appraisers, LLC in amount not to exceed 50% of estimated value shown on consignment form and agreed to by both parties. Damaged, lost or stolen items in shipment are covered by insurance required to be purchased by the buyer. Consignor agrees that notification of failure of item to sell may be made by telephone or email and need not be made in writing. Once notified, consignor will make every effort to pick up unsold items promptly. Items not picked up within 60 days of notification of failure to sell will become the property of Bixby Auctioneers and Appraisers, LLC and may be disposed of in any manner they deem appropriate. By signing this contract, you declare that you are the legal owner or authorized agent for the owner of the items being consigned for sale and in the event of a dispute over ownership will hold Bixby Auctioneers and Appraisers, LLC harmless.
